Why MoCRA compliance matters
The FDA's Modernization of Cosmetics Regulation Act (MoCRA), signed December 2022, created new requirements for cosmetic makers — even small ones. While businesses under $1M revenue are exempt from product listing and facility registration, all cosmetic makers must maintain:
- Safety substantiation records for every product
- Responsible person designation on all labels (required since December 2024)
- Adverse event reporting for serious events within 15 business days
- INCI ingredient labeling in descending order by weight
Note: Eye-area products do NOT qualify for the small business exemption regardless of revenue. Candles are CPSC jurisdiction, not FDA — no MoCRA requirements apply. True soap (saponified oils only, no beauty claims) is also exempt.
